What is a patent application?
The application contains information on the title of the invention, the filing date, the priority date (if claiming domestic or international priority) and personal details, such as the name of the inventor and the name and address of the applicant.
Every patent application must be limited to one invention or utility model. This limitation is related to the so-called unity of invention criterion; if this is not met, the applicant can limit the claims and if necessary file one or several patent applications (divisional application). If the application includes several inventions, the Italian Patent and Trademark Office (UIBM) can intervene officially and invite the applicant to limit the application to one invention, with the right to submit for each of the remaining inventions separate applications, which will be effective from the date of the original application.
Applicants submitting an application for an industrial invention can submit the patent application of the utility model at the same time. The Office will assess whether the application can be granted as an invention or a utility model once all the requirements have been examined. Moreover, the patent application can be converted from invention to utility model or vice versa.
Patent application claims.
The claims determine the requested field of protection. Art. 52 of the Italian Industrial Property Code expressly provides that “the claims must contain what one believes should be the object of the patent. The protection limits are determined by the claims”: this is why extreme attention is required when writing them. The interpretation of the patent and assessment of its strength is founded on them.

Publication of the patent application.
The patent application can be accessed 18 months from the filing date. However, the patent holder can request an advance publication (in any case no earlier than 90 days from when it was filed).
Grant. If the examination procedure is successful, the UIBM issues the relative certificate. Pursuant to art.53 of the Italian Industrial Property Code, when the patent is granted, the exclusive rights considered in the Code are granted as well. However, the effects of the patent become effective from the date when the application with the description and any drawings was made available publicly. After 18 months from the filing date or the priority date – i.e. 90 days after the application was filed if the applicant declared in the application itself the intention to make it immediately available publicly – the Office will make the application and documents enclosed available to the public. If the applicant wants the patent application to have effects towards a third party established at an even earlier date, the applicant can inform the third party of the patent application. In this case the effects of the application in relation of the notified party become effective from the notification date.
